REMIND YOUR CUSTOMERS THAT THEIR OBLIGATIONS
AS BUSINESSES ARE TO:

COMPLY WITH THE OBLIGATIONS UNDER THE EXTENDED PRODUCER RESPONSIBILITY.

Merchants must take informative and financial responsibility for meeting the objectives set by RD 1055/2022.

The main compliance options are described below:

1. Reach a collaboration agreement with their manufacturer and/or distributor of service packaging.

2. Participate directly through a Producer Responsibility Organization such as the one managed by Ecoembes

SIGN UP IN THE REGISTER OF PRODUCT PRODUCERS  
(PACKAGING SECTION)

This obligation depends on the Ministry for the Ecological Transition and Demographic Challenge (MITERD) and provides a control mechanism for placing packaging on the market

Once listed in the Register of Product Producers, the category of packaging placed on the market must be reported annually.

REMEMBER THAT YOUR
CUSTOMERS CAN ALSO DELEGATE THEIR
RESPONSIBILITIES TO THEIR MANUFACTURER OR
DISTRIBUTOR OF SERVICE PACKAGING TO HAVE IT DO ALL THE PAPERWORK.

Your customers have the option to enter into a collaboration agreement with their service packaging manufacturer and/or distributor to have the latter provide this additional service, helping them to fulfil their responsibility to manage the packaging waste.

For example, if your customer has a butcher shop, fruit shop, etc., it would be its manufacturer or distributor of bags, tubs, trays, or any other service packaging they use, that would handle the register of producers and the annual packaging declaration.

You can tell your customers to call the manufacturer or distributor they usually work with and delegate to it all the processes related to the new Royal Decree on Packaging. This way, it will be this manufacturer and/or distributor who does all the processes required.

HOW CAN THEY DO IT?

Call your service packaging manufacturers and/or distributors and ask them to comply on your behalf.

Make sure the service packaging manufacturers and/or distributors comply with your obligations under Royal Decree 1055/2022, in the following terms:

That they are registered in the Register of Producers. Listed HERE*

That the invoices you receive from your supplier show their Registration Number in the Register of Producers and details the contribution made to the PRO for said service packaging that they supply to you.

Keep any documentation that can demonstrate your compliance with your legal obligations.

HOW CAN YOUR CUSTOMER BE SURE THAT THE
MANUFACTURER AND/OR DISTRIBUTOR OF THE SERVICE PACKAGING
COMPLIES WITH IT?

1.

It should ask the manufacturer and/or distributor for detailed information on how it handles the packaging waste.

2.

It should ask it to provide it with documentation proving its compliance with the obligations.

3.

Ask it to include on its invoice a reference that it is complying with the obligations of the Royal Decree on behalf of the merchant.

AN AGREEMENT WITH ECOEMBES?

Another possible way to comply with your packaging obligations is to participate directly through a Producer Responsibility Organization system, like the one managed by Ecoembes.

Inform your customers that if they are interested in having us help, or if they want information, they just have to:

SIGN A MEMBERSHIP CONTRACT WITH ECOEMBES.

Ecoembes can help you enrol in the Register of Producers and with the packaging declaration that you will also have to file with this Register of Producers.

SUBMIT THE PACKAGING DECLARATION ANNUALLY BEFORE 28 FEBRUARY.

To do this, they must have the technical information needed to submit the declaration:

materials the packaging is made of: cardboard, paper, plastic, aluminium...

measurements and weights of this service packaging.

PAY THE INVOICES ASSOCIATED WITH THE PACKAGING DECLARATION TO ECOEMBES.
