It affects all businesses that sell products with service packaging, regardless of the sector or whether they are small or large
COMPLY WITH THE OBLIGATIONS UNDER THE EXTENDED PRODUCER RESPONSIBILITY.
Merchants must take informative and financial responsibility for meeting the objectives
set by RD 1055/2022.
The main compliance options are described below:
1. Reach a collaboration agreement with their manufacturer and/or distributor of service packaging.
2. Participate directly through a Producer Responsibility Organization such as the one managed by Ecoembes
SIGN UP IN THE REGISTER OF PRODUCT PRODUCERS
(PACKAGING SECTION)
This obligation depends on the Ministry for the Ecological Transition and Demographic Challenge (MITERD) and provides a control mechanism for placing packaging on the market

Once listed in the Register of Product Producers, the category of packaging placed on the market must be reported annually.

You can meet all your responsibilities by delegating them to the manufacturer and/or distributor of your service packaging.
CONTACT YOUR MANUFACTURER AND/OR DISTRIBUTOR OF SERVICE PACKAGING AND ASK
If you choose this option to reach a collaboration agreement with your manufacturer and/or distributor of service packaging in which it provides you this additional service, you will be satisfying your obligations.
For example, if you have a butcher shop or fruit shop, it would be your supplier of bags, wrappers or boxes that would handle the obligations.
Call the manufacturer and/or distributor you regularly work with and ask it to fulfill these obligations on your behalf.
Call your service packaging manufacturers and/or distributors and ask them to comply on your behalf.
Make sure the service packaging manufacturers and/or distributors comply with your obligations under Royal Decree 1055/2022, in the following terms:
That they are registered in the Register of Producers. Listed HERE*
That the invoices you receive from your supplier show their Registration Number in the Register of Producers and details the contribution made to the PRO for said service packaging that they supply to you.
Keep any documentation that can demonstrate your compliance with your legal obligations.
Another possible way to comply with your packaging obligations is to participate directly through a Producer Responsibility Organization system, like the one managed by Ecoembes.
If you are interested in fulfilling your obligations in this way,
you just have to:
SIGN A MEMBERSHIP CONTRACT WITH ECOEMBES.
Ecoembes can help you enrol in the Register of Producers and with the packaging declaration that you will also have to file with this Register of Producers.
SUBMIT THE PACKAGING DECLARATION ANNUALLY BEFORE 28 FEBRUARY.
To do this, you must have the technical information needed to submit the declaration:
materials the packaging is made of: cardboard, paper, plastic, aluminium...
Units and weights of this service packaging.
Remember: you can delegate the process to your manufacturer and/or distributor of service packaging and have it handle everything.
