SERVICE PACKAGING MANUFACTURERS/DISTRIBUTORS ARE AFFECTED AND HOW?

It affects all manufacturers and/or distributors whose customers are merchants to which they supply service packaging, regardless of whether they are small or large, or if they sell food, clothing, electronics, etc.

As a manufacturer and/or distributor, this royal decree does not affect you as a responsible party, but joining this service can offer a series of significant advantages for you and your customers.

THE NEW ROYAL DECREE
ON SERVICE PACKAGING

It expands the possibility of establishing voluntary agreements on all service packaging between manufacturers and/or distributors and merchants:

It gives the manufacturer and/or distributor the possibility of declaring all this service packaging and not only for single-use bags provided or purchased in the store, as was the case until now.

This agreement affects:

Manufacturers

Companies that distribute this service packaging

Intra-Community purchasers of this service packaging

Importers of this service packaging

It lets you partner with your customers to have you handle the paperwork.

You have the option to enter into a collaboration agreement with your customer to have you provide this additional service, helping it to fulfil its responsibility for managing the waste from service packaging.

For example, if you manufacture and/or distribute service packaging, such as boxes, bags, plastic packaging, etc., you can take responsibility for your customers in terms of registering them in the register of producers and filing their annual packaging declaration. Ecoembes will help you with all these processes and you will enjoy a series of benefits.

HOW CAN YOU ESTABLISH
AGREEMENTS WITH YOUR CUSTOMERS?

Negotiate an agreement with your customer, laying out the responsibilities of each party in managing the packaging waste.

Be sure to comply with the obligations of Royal Decree 1055/2022 as a provider of packaging waste management services:

Be registered in the register of Product Producers.

Submit the necessary documentation by the deadline.

Send the supporting documentation to your customers, the businesses that have delegated the procedures to you, since they are ultimately responsible for complying with the law.

02 WHAT DOES IT MEAN TO ACCEPT THE DELEGATION OF
RESPONSIBILITY FROM A MERCHANT?

If the merchant decides to delegate the management of service packaging to the manufacturer and/or distributor of its service packaging, the latter must sign a collaboration agreement with a PRO (Producer Responsibility Organization) for domestic packaging, such as Ecoembes.

WHAT DOES THE MANUFACTURER AND/OR DISTRIBUTOR OF SERVICE PACKAGING HAVE TO DO?

Sign a membership contract with Ecoembes.

Register in the Register of Producers and report annually on the service packaging placed on the market by all your merchants.

Every year before 28 February, submit to the Ecoembes PRO the Declaration of Service Packaging sold to your merchants, where you will identify the merchants you represent.

03 HOW CAN YOU BE SURE THAT YOU ARE FULFILLING
YOUR PART OF THE AGREEMENT?

1.

You can provide your customer with information on how you handle the service packaging waste for each customer you represent.

2.

Provide your customer with the documentation that proves your compliance with the obligations.

3.

Include in the invoices your Registration Number in the Register of Producers, and also detail the contribution made to your collective system, such as Ecoembes, for the service packaging you supply to your customers.

Una vez inscritos en el Registro de Productores de producto se deberá informar anualmente de la categoría y de la cantidad de envases de servicio puestos en el mercado.

Merchants must take informative and financial responsibility for meeting the objectives
set by RD 1055/2022.
